SADRİ MAKSUDİ ARSAL’IN DEVLET YAKLAŞIMI

Bu çalışma, Sadri Maksudi Arsal’ın günümüze ulaşan eserleri ve fikirleri üzerinden yapılan bir analiz ile Arsal’ın Genel Devlet Teorisi ve Türk Devlet Teorisi’ni ortaya koymayı amaçlamaktadır. Literatür taraması ile Arsal’ın günümüze ulaşan eserleri devlet merkezli bir analizden geçirilmiştir. Tarihi, hukuk ve devlet merkezli okuyan Arsal’ın geride bıraktığı eserler, gerek Genel Devlet Teorisi gerekse Türk Devlet Teorisi için zengin kaynaklardır. Türk Devlet Teorisi’ne ilişkin farklı dönemlendirmelere başvurmuş ve bu dönemlerin özelliklerini ve farklarını ortaya koymuştur. Devletin kökenine ilişkin kuramları ve devlet teorilerini ele almış, daha sonrasında kendi teorisini temellendirmiştir. Birden çok devlet tanımı ile zihnindeki devlet formunu belirginleştiren Arsal, devlet bilimi çalışmaları için hukuk dünyası gözünden çok önemli bir katkı sunmuştur. Arsal’ın eserleri üzerinden onun Genel Devlet Teorisi, Türk Devlet Teorisi ve devlet bilimine ilişkin katkılarını analiz edebilmek mümkündür. Çalışmalarında yalnızca “Türk yönetim geleneğinde Bizans etkisi” ve “Türk Devlet Teorisi’nde modernleşme dönemi” başlıkları eksiktir.

This study aims to reveal Arsal's Theory of the State and the Theory of the Turkish State through an analysis based on the ideas and works of Sadri Maksudi Arsal. As a result of the literature search, all accessible works of Arsal have been subjected to a state-centered analysis. Studying history, law and the state, Arsal's works are rich sources for both the General Theory of the State and the Theory of the Turkish State. He has revealed the different periods related to the Theory of the Turkish State and the characteristics and differences of these periods. On the other hand, he dealt with theories about the origin of the state, and later based his own theory on it. Arsal, who has made the form of the state clear in his mind with different definitions of the state, has made a very important contribution to the studies of state science from the point of view of the law. It is possible to analyze Arsal's contributions to General Theory of the State, Theory of the Turkish State and state theory through his works. Only the Byzantine influence on Turkish administrative tradition and the period of modernization in Turkish State Theory are missing in his works.
