İslam aile hukukunda kocanın naşize eşini te'dib hakkı

Allah (c.c) her canlıyı kendi cinsinden bir eş ile birlikte yaratmış ve aralarında çekim oluşturacak duygularla donatmıştır. Yeryüzündeki ilk çift ile başlayan kıyamete kadar da devam edecek olan eşler arasındaki bu çekim, evlilik kurumunu doğurmuştur. Allah (c.c) kadınla erkeği fıtrat olarak farklı fakat birbirini tamamlayacak özelliklerde yaratmış ve aralarındaki birlikteliğin mutlu bir şekilde devamı için her birine ayrı sorumluluklar yüklemiştir. Eşlerin fıtrat özellikleri farklı olduğu gibi evlilikteki sorumlulukları da farklıdır ve sorumluluklarının bilincinde olmaları, sorumluluklarını yerine getirmeleri de evliliğin olmazsa olmazlarındandır. Sevgi ve muhabbetin devamlılığı için eşlerin sorumlulukları noktasında karşılıklı çaba göstermeleri gerekmektedir. Aksi takdirde ailenin dağılması kaçınılmazdır. Bu noktaya gelmiş karı koca ilişkilerinde tarafların nasıl davranacakları evlilik ve aile kurumu için çok önemlidir. Bu çalışmada öncelikle İslam hukukunda eşlerin karşılıklı hak ve sorumlulukları bağlamında; kocanın nâşize hanımını tedip etme konusunun amacı, önemi ve sınırlarına yer verilmiştir. Genel olarak eşlerin birbirlerine karşı hak ve sorumlulukları ele alınmıştır. Kadının nüşûzu halinde kocanın kadın üzerindeki te'dip hakkının; amacına, sınırlarına, kocanın aile içindeki sorumluluklarıyla bağlantısına ve bunun kadına şiddet kapsamında değerlendirilip değerlendirilemeyeceğine, çağdaş aile yapısının ve şartların kocanın te'dib hakkına olan etkisine değinilmiştir.

Allah created men and women with different but complementary characteristics in terms of nature, and placed different responsibilities on each of them for the happy continuation of their relationship. Just as the nature of spouses is different, their responsibilities in marriage are also different, and being aware of their responsibilities and fulfilling their responsibilities are indispensable for manage. For continuity of mutual love and fondness, spouses must make mutual efforts regarding their responsibilities. Otherwise, the break up of the family is inevitable. How they behave in husband-wife relationships that have reached this point is very important for the institution of marriage and family. In this study, first of all, the purpose and importance and limits of the issue of the husband's discipline of his wife in the context of the mutual rights and responsibilities of the spouses in Islamic law are included. In general, the rights and responsibilities of spouses to each other were discussed. The husband's right to discipline over an ornery wife, its purpose, limits, the husband's connection with his responsibilities in the family, whether this can be considered within the scope of violence against women, the impact of modern family structure and conditions on the husband's right to discipline is mentioned.
