SURİYELİ MÜLTECİLER ve TÜRKİYE’DE MÜLTECİ SORUNU

Bu çalışmada “mülteci” kavramından hareketle, insan hakları ve mülteci bağlantılı olarak mülteci hakları alanındaki ulusal ve uluslararası mevzuat ile ulusal mevzuattaki yenilikler ve Türkiye’deki Suriyeli mültecilerin mevcut varlığı araştırılmıştır. Türkiye, tarihinin en büyük göç hareketlerinden biriyle karşı karşıyadır. Nisan 2011’den itibaren Türkiye’ye sığınmaya başlayan Suriyelilerin sayısı 2015 yılı sonu itibariyle resmi verilere göre 2.764.500 üzerindedir. Sığınmacı sayısının ve sığınma süresinin öngörüleri fazlasıyla aşması ve sürecin büyük bir belirsizlik içine girmesi büyük bir problem oluşturmaktadır. Eğer Suriye’den Türkiye’ye göç edenlerin algılamaları ve göçler hakkında tam bir anlayışa sahip olunduğu takdirde, bu insanlık krizine bir çözüm bulunabileceğine inanılmaktadır.Mülteci ve sığınmacı kavramlarının Türk mevzuatında ayrı ayrı düzenlenmesi, Türkiye’nin Mültecilerin Hukuki Statüsüne İlişkin 1951 Sözleşmesi’ne ve Mültecilerin Hukuki Statüsüne İlişkin 1967 Protokolü’ne koyduğu coğrafi çekince ve son yıllarda artan mülteci akınları, Türkiye’nin mülteci hareketleri ve mülteci hakları konusunda yeni düzenlemelere ve politikalara ihtiyaç duyduğunu göstermiştir. 6458 Sayılı Yabancılar ve Uluslararası Koruma Kanunu ve Geçici Koruma Yönetmeliği ile mültecilerin korunması hususunda önemli hukuksal ve idarî değişiklikler yapılmıştır. 

This study will research, new national and international legislation, within the context of refugees, the relation between refugee and human rights and the situation of the Syrian refugees in Turkey. Turkey is facing one of the greatest immigrations in its history. According to the official data, the number of the Syrians who have taken migrated in Turkey at the end of the year 2015 since April 2011 is more than 2 000 000. The fact that the number of migrated and time of taking refuge have significantly surpassed the numbers, which were expected, and that there is much uncertainty in this process a major problem. It is certain that should there be a full understanding about migration and migrants perceptions from Syria to Turkey, for solution to this humanitarian crisis be found. Turkey’s treating the concepts of refugee and asylum seeker separately, the geographical reservations about the 1951 Covenant on the Legal Status of Refugees and the 1967 Protocol on the Legal Status of Refugees, and the influx of refugees in the last years have revealed that Turkey urgently needs new regulations and policies about the refugee rights and refugee influxes. Both with the Law on Foreigners and International Protection number 6458 and the Regulation on Temporary Protection there has been significant legal and administrative changes for the protection of refugees.
