dc.description.abstractHazırlanmış olan tezin amacı, küçük çocukların evlendirilmesi meselesinin Hanefî mezhebi ve Şafiî mezhep imamları açısından nasıl değerlendirildiğini incelemektir. Yapılan bu çalışmanın giriş bölümünde araştırmanın konusu, amacı ve öneminden bahsedilmiş, takip edilen metot ve kullanılan kaynaklar hakkında bilgiler verilmiştir. Birinci bölümde; kanun, nikâh, küçüklük, muhayyerlik ve temyiz kavramları açıklanmıştır. İkinci bölümde, birinci bölümde bahsedilen kavramlar, Hanefi mezhebinde nasıl değerlendirildiği ayrıntılı bir şekilde ele alınmıştır ve araştırmanın konusu ayetler ve hadisler ışığında incelenmiştir. Üçüncü bölümde kavramların Şafiî mezhebi tarafından nasıl değerlendirildiği ve konuya bakış açıları ele alınmıştır. Dördüncü bölümde küçük çocukların evlendirilmesine karşı çıkan İslâm düşünürlerinin görüşleri ele alınmıştır. Sonuç bölümünde genel bir değerlendirme yapılarak araştırma tamamlanmıştır.
dc.description.abstractThe aim of this thesis is to examine how the marriage of young children is evaluated in terms of hanafi sect and Shafii sect. In the introduction part of this study, the subject, purpose and importance of the research are mentioned, information about the method followed and the resources usedhas been given. In the fırst part; The concepts of law, marriage, childhood, imagination and appeal are explained. In the second part, the concepts mentioned in the fırst part are discussed in detailed how they are evaluated in Hanafi sect and the Shafii sect subject of the research is examined in the light of verses and hadiths. In the third chapter, how the concepts are evaluated in the Shafii sect and the points of view of the subject are discussed. In the fourth section, the views of Islamic thinkers who oppose the marriage of young children are discussed. In the conclusion, a general evaluation has been made and the research has been completed.
