İslam Hukukuna göre velayette babanın öncelik hakkı

Bizim araştırdığımız "Velayet" konusuna naslarla işaret edilmekle birlikte, velayet konusunun detayları İslam hukukçularının içtihatlarıyla zenginleştirilmiştir. Eşref-i mahluk olan insanın doğuştan sahip olduğu temel hak ve hürriyetlerin korunması adına velayet hükümlerinin istinbat ve icrası bir ihtiyaçtır, zorunluluktur. Araştırmamızda kavramsal çerçeveyi oluşturup, velayetin kimler için ihtiyaç olduğunu belirledik. Velilik vazifesini kimlerin yapacağını ve velinin taşıması gereken vasıfları sıraladık. Pozitif hukuk ile İslam hukukunun velayet hükümlerini yazarak iki hukuk sisteminin kaynağına dolaylı atıfta bulunup yorum farklarını göstermeye çalıştık.

According to İslam Law Father's Priority Right of Guardianship. The rules that organizes the human life are defined by the Holy Koran and The Sunnah. But all of them can not be organized by Koran and Sunnah that some of them are clarified by the judicial opinion of the Islamic Jurists with in the same line so that the human life got rid of the stationary mood. The topic "Guardianship" we are studying is signaled with the hadith besides its details are enriched by the judicial opinion of the Islamic Jurists. As the most honorable creature of the earth that it is necessary and to protect the Guardianship Ruling on the name of human rights and its freedom. We determined for whom Guardianship is a necessity after drawing the frame. We put in order who will take over the responsibility of parentage and which qualifications the parents should meet. By writing the context of both the Current Law and İslamic law, we tried to show the comment differences between each other as well as their roots.
