Uluslararası hukukta uluslararası terörizm ve devletlerin iş birliği sorunu: Yemen örneği

Abstract

Uluslararası hukuk kavramları açısından uluslararası terör kavramının tanımlanmasının önemi ve tanımın yapılamamasının getirdiği olumsuz sonuçlar üzerinde duran bu çalışma nitel araştırma yöntemlerinden doküman tarama modeli ile hazırlanmıştır. Bu çalışma, uluslararası terörizm kavramının tanımının zorluklarına ve bu tanımın gerekliliğine dikkat çekmektedir. Ayrıca farklı tanımların uluslararası terörizmle mücadelede sorunlar yarattığı da vurgulanmaktadır. Tez, terör ve uluslararası terörizm kavramlarıyla ilgili literatürdeki tanımları, terörün sınıflandırılmasını ve tarihsel sürecini ele almaktadır. Ayrıca uluslararası örgütlerin terörizm tanımlarına ve ülkelerin terörle mücadele yasalarına da yer verilmektedir. İngiltere ve Türkiye'nin terörle ilgili yasal düzenlemeleri incelenmiştir çünkü bu ülkeler önemli terörle mücadele deneyimine sahiptir. İngiltere'nin daha gelişmiş bir yasal altyapıya ve deneyime sahip olduğu düşünülebilirken, Türkiye'nin Orta Doğu ve güvenlik dinamikleriyle ilişkili olması bakımından farklı bir perspektife ve yaklaşıma sahip olabileceği düşünülmüştür. Son bölümde ise Yemen sorunları ele alınmıştır. Yemen'deki istikrarsızlık ortamının terör örgütlerine uygun bir zemin oluşturabileceği ve bazı grupların self determinasyon veya özerklik taleplerinin terör eylemlerine dönüşebileceği belirtilmektedir. Terörizm faktörünün uluslararası müdahalelere etki ettiği ve bu nedenle Yemen sorunlarının tez için uygun bir çalışma konusu olduğu ifade edilmektedir. Yemen'de faaliyet gösteren El Kaide ve İslam Devleti gibi terör örgütlerinin varlığı, uluslararası terör ve self-determinasyon konularının Yemen'in bir tezde ele alınmasının ana nedenlerinden biri olarak öne çıkmaktadır. Yemen, son dönemde terör saldırıları ve iç savaşlarla sarsılan bir ülke olarak öne çıkmaktadır. Bu durum, uluslararası terörle mücadelede alınan veya alınmayan önlemleri ve self-determinasyonun uygulanmasını etkileyen eylemleri incelemek için önemli bir örnek teşkil etmektedir.

This study, conducted using the qualitative research method of document analysis, focuses on the importance of defining the concept of international terrorism in terms of international law and the negative consequences of the inability to establish a clear definition. It aims to draw attention to the difficulties in defining the concept of international terrorism and the necessity of such a definition. Furthermore, it emphasizes the problems caused by different definitions in the fight against international terrorism. The thesis addresses the definitions of terrorism and international terrorism found in the literature, as well as the classification and historical context of terrorism. It also includes the definitions of terrorism by international organizations and the counter-terrorism laws of various countries. The counter-terrorism legislations of the United Kingdom and Turkey are examined due to these countries' significant experience in combating terrorism. While the United Kingdom is considered to have a more advanced legal framework and expertise, Turkey may have a different perspective and approach due to its relations with the Middle East and security dynamics. The final section of the study focuses on the issues in Yemen. It highlights how the unstable environment in Yemen can provide a fertile ground for terrorist organizations and how certain groups' demands for self-determination or autonomy can turn into acts of terrorism. The study also mentions the impact of terrorism on international interventions, making Yemen issues a suitable subject for investigation. The presence of terrorist groups such as Al-Qaeda and ISIS in Yemen stands out as one of the main reasons for addressing the topics of international terrorism and self-determination in a thesis about Yemen. Yemen has recently been destabilized by terrorist attacks and internal conflicts, making it an important case to examine the measures taken or not taken in the fight against international terrorism and the implementation of self-determination principles.
