İslam Hukukunda mahremiyet ve sosyal medya

"İslam Hukukunda Mahremiyet ve Sosyal Medya" adlı tezimizde, İslam hukukundaki mahremiyet sınırları çizilmiş ve bu sınırların ne kadarının sosyal medyada ihlal edildiği ortaya çıkarılmaya çalışılmıştır. Gerçekleşebilen bu ihlaller sonucunda fert ve toplumun üzerine düşen sorumluluklar ile hukuki yaptırımlar ele alınmıştır. Birinci bölüm, konuyla alakalı kavramları içermektedir. Mahremiyet olgusuyla ilişkili kavramlar açıklanmış ayrıca sosyal ağ siteleri hususunda önemli aktarımlar yapılmıştır. İkinci bölümde mahremiyetin İslam hukukundaki boyutları beden, mesken, bilgi, mahremiyeti kapsamında değerlendirilmiştir. Günlük yaşamdaki ibadetlerin mahremiyetle ilgisi de ele alınmıştır. Bu bölüm, İslam hukukundaki alanı belirlenen mahremiyetin nasıl ve ne şekilde olursa ihlalinin söz konusu olacağına dair hareket noktası olmuştur. Üçüncü ve son bölüm mahremiyetin sosyal medyada ne kadar yitirildiğinin ve bunun sonucunda hukuki zeminde neler yapılması gerektiğinin ortaya çıkarılmaya çalışıldığı bölüm olmuştur. Bu bölümde sosyal medyanın beden, mesken, bilgi, aile ve ibadet mahremiyetine etkilerini değerlendirirken yer yer güncel olaylara başvurulmuştur. In this thesis called "Privacy in Islamic Law and Social Media", boundaries of privacy in Islamic Law are drawn and the extent of the boundary violations in social media is attempted to be revealed. As a result of these occurring violations, the responsibilities incumbent upon individuals and community are approached along with law enforcement. The first section includes the concepts relevant to the subject. The concepts related to privacy matter are explained and some important details about social networks are given. In the second section, the extents of privacy in Islamic Law are evaluated within the privacy of body, residence, and information. Also, the relation between daily prayers and privacy is discussed. This section is the starting point regarding how and in what way violation occurs in the area of privacy which is determined in Islamic Law. The third and last section is the section about an attempt to reveal to what extent privacy is lost in social media and as a result of this, what are the necessary actions in legal grounds. In this section, there are references to current events while evaluating the effects of social media to body, residence, information and family privacy. Moreover, it is emphasized that subjects in question should be included in relevant sections of Fiqh books. Key Words: Haram, Privacy, Social Media, Personal Right, Islamic Law
