?İslam Hukukuna Göre Akitlerde Cehalet (Bilinmezlik) ve Akde Etkisi? isimli tezimizde, insanların sosyal hayatında önemli bir yeri olan ?akitler? konusu ele alınmakta ve özellikle akitlerin geçersiz olmasında en çok etkisi görünen etkenlerden biri olan ?cehalet? konusu işlenmektedir.Bu bağlamda tezimiz, akitlerle ilgili ?Teorik Çerçeve? ve ?Bilinmezlik Kavramı, Bilinmezliğin Kapsamı, Akde Etkisi? olmak üzere iki ana bölümden oluşmaktadır.Birinci bölümde akitlerle ilgili teorik çerçeve ele alınmakta, akitlerin kuruluşu, geçerlilik dereceleri, hukukî sonuçları ve sona ermesi incelenmektedir. Tezimizin temelini oluşturan ikinci bölümde ise öncelikle bilinmezlik kavramının üzerinde durulmakta ve çerçevesi tespit edilen bilinmezliğin, özellikle satım akdi olmak üzere muhtelif akitlere tesiri ortaya konulmaktadır.

This thesis titled ?Ignorance ( Uncertanty) in Contracts and its Effect on the Contract with Respect to Islamic Law? deals with ?contracts? which play a crucial role in social life and it treats the subject of ?ignorance? which inures the nullification of contracts.In this context, this thesis consists of two main chapters: One is the ?theoretical framework? concerning the covenants and the other is ?the concept of darkness, the scope of darkness, and its effects on contracts.?The first chapter deals with the theoretical framework of contracts. It is being approached to the making contracts, the degrees of their validity, legal results of the contracts and ending of the contracts.The second chapter forms the heart of the thesis and it deals with the concept of darkness. After the scope of darkness is being determined, the effects of the darkness on the contracts, especially on sales contracts, are being examined.
