dc.description.abstractİnsanlar toplum halinde yaşamaya başladıktan sonra kendi aralarındaki ilişkileri düzenleyebilecek ve herşeyin üstünde yer alacak bir devlet kurumuna ihtiyaç duymuşlardır. Devlet, toplumun ihtiyaçlarına göre kanunlar yapma, düzeni sağlayabilmek için gerekli gördüğü yerlerde yaptırım uygulama, toplumun iç ve dış güvenliğini sağlama ve uluslararası alanda toplumun tamamını temsil etme gibi çok önemli fonksiyonlara sahiptir.Yönetim, devletin vazgeçilemez bir unsurudur. Devlet, yönetim unsurunu kullanarak fonksiyonlarını yerine getirir. Yönetim insanın kendisini yönetmek gibi dar bir çerçeveden başlayarak bir devleti yönetmek ve tüm dünyayı hükmetmeye kadar geniş bir alanda kendisini hissettirmektedir.Yönetim tek başına çok fazla fonksiyonel bir yapıda değildir. Yönetimin eksikliklerini denetim tamamlamaktadır. Denetim sayesinde yanlışlar ortaya çıkmakta ve aynı yanlışların tekrardan meydana gelmemesi için önleyici bir görev yapmaktadır.Denetim, yönetimin her alanında farklı isimler altında kendisini göstermektedir. İdari denetim, siyasi denetim, yasama denetimi, kamuoyu denetimi, uluslararası denetim ve ombudsman denetimi olmak üzere başlıca denetim türleri bulunmaktadır. Bu denetim türleri farklı alanlarda farklı fonksiyonları yerine getirmektedirler. Bu denetim türleri karşılaştırıldığında çalışma alanı ve uygulamalar anlamında en serbesti Ombudsman Denetimi olarak değerlendirilebilir.Bu çalışmada Ombudsman konusu tarihi geçmişinden günümüze kadar süreçte incelenmiştir. Türkiye'de yakın bir tarihte faaliyete geçmesi beklenen Türk Kamu Denetçiliği Kurumu hakkındaki yasal düzenleme ve konunun genel değerlendirilmesiyle çalışma tamamlanmıştır.Anahtar Kelimeler: Kamu Yönetimi, İdarenin Denetimi, Kamu Denetçiliği, Ombudsman, Denetim, İdare Hukuku
dc.description.abstractAfter people started living together as a community, there was a need of for a superior governmental instutition to govern and organize interrelationships. The state has vital functions, according to the needs of the society to make laws, enforcing sanction to ensure law and order where necessary, providing internal and external security and representing the community at an international level.Governance is an irreplaceable element of the state. By using the element of governing the state fulfills its functions. Governance begins from a narrow framework of people governing themselves to a larger one of the state governing itself to the governing of the entire world.Governance alone is not a functional structure. The deficiencies of governance are complemented by inspection. By means of inspection, mistakes occur and it serves preventive task in order that the same mistakes are not repeated again.Inspection presents itself in all aspects of governance under different titles. Administrative inspection, political inspection, legislation inspection, public opinion inspection, international inspection and ombudsman inspection are the main types of inspection. These types of inspection perform different functions in varied areas. When these inspection systems are compared by means of working area and application the freest one can be evaluated as Ombudsman Inspection.In this study, The Ombudsman has been studied from historical past to the present. The study has been completed with the legal regulation and general assessment about The Turkish Ombudsman Institution which is expected to be started operation in Turkey in the near future.Keywords: Public Administration, Control Of The Administration, Public Inspection, Ombudsman, Inspection, Administrative Law
