Türkiye'de kamu kurumlarının ombudsmanlık denetimi üzerine nitel bir araştırma

Hukuk devleti niteliği taşıyan devletler, insan haklarına dayalı adalet anlayışı ve demokrasi kültürünün benimsenmesini amaçlamaktadır. Bu anlayışla yaygınlaşan ombudsmanlık kurumu bireylerin korunması ve kötü yönetimin önlenmesi amacıyla kamu kurum ve kuruluşlarını denetlemektedir. Ombudsmanlık kurumu birey ve idare arasındaki sorunlara dostane çözüm yöntemiyle arabuluculuk görevini yürütmektedir. Dünyada ombudsmanlık kurumunun tarihsel kökeni 18. yüzyıla dayanmaktadır. İlk ombudsmanlık kurumu İsveç'te kurulmuştur. Ombudsmanlık dünyada 198 ülkede benzer örnekleriyle uygulanmaktadır. "Türkiye'de Kamu Kurumlarının Ombudsmanlık Denetimi Üzerine Nitel Bir Araştırma" başlıklı bu çalışmada aldığı kararlar ile idareye yol gösterici olan ombudsmanlık kurumu ve denetimi anlatılmaktadır. Bu çalışmada dünyada ombudsmanlık uygulamalarından da örnekler verilmiştir. Türkiye'de iyi yönetimin yaygınlaşması ve vatandaşların idareye yönelik sorunlarının çözülmesi görevini üstlenen Kamu Denetçiliği Kurumu, 2010 Anayasa değişikliği ile anayasal bir kurum olarak 6328 sayılı Kamu Denetçiliği Kurumu Kanunu ile 2012 yılında kurulmuştur. Bu araştırmanın temel konusunu Türkiye'de ombudsmanlık denetimini gerçekleştiren Kamu Denetçiliği Kurumu oluşturmaktadır. Bu araştırmada Kamu Denetçiliği Kurumunda görevli uzman ve uzman yardımcıları belirlenmiş ve 21 kişiyle görüşme yapılmıştır. Veriler Maxqda 2020 nitel veri analiz programı ile çözümlenmiştir. Kamu Denetçiliği Kurumu alan araştırması doğrultusunda kurumun iyi yönetim ilkelerini benimseyerek birey ve idare arasındaki sorunlara hızlı ve etkili olarak kararlar aldığı tespit edilmiştir. The ombudsman institution, which has become widespread with this understanding, audits public institutions and organizations in order to protect individuals and prevent bad management. The Ombudsman Institution carries out the mediation task of the problems between the individual and the administration with the method of friendly solution. The historical origin of the ombudsman institution in the world dates back to the 18th century. The first ombudsman institution was established in Sweden. Ombudsman is practiced in many countries of the world with similar examples. "A Qualitative Research On Ombudsman Audit For Public Institutions In Turkey", this thesis is guiding the decisions taken by the administration in the study describes the ombudsman institution and supervision. In this study, examples of ombudsman practices in the world are given. Turkey on good governance widespread and citizens who assume the task of solving problems for the administration Ombudsman Institution, as a constitutional institution with a 2010 constitutional amendment 6328 No. Ombudsman was established in 2012 with Corporate Law. The main topics of the Ombudsman performs inspections in Turkey, this study constitutes the ombudsman institution. In this study, experts and assistant experts working in the Ombudsman Institution were determined and 21 people were interviewed. The data were analyzed with the Maxqda 2020 program. In line with the field research of the Ombudsman Institution, it has been determined that the institution adopts the principles of good management and makes quick and effective decisions on the problems between the individual and the administration.
